Terms of Service

1. Agreement to these terms

NovaUp is provided by Pixel Geek LLC. By creating an account, signing in, or using NovaUp, you agree to these Terms of Service.

2. Who can use NovaUp

You must be at least 13 years old or the minimum age of digital consent in your country. You are responsible for keeping your account credentials secure.

3. Your content

Your Sparks, notes, photos, and other content belong to you. You grant NovaUp a limited license to store, process, and display it so the Service can function, including showing history and generating summaries.

4. Acceptable use

Do not break the law, upload unlawful or harmful content, access other users' data, disrupt the Service, scrape or spam it, misuse AI safety measures, or impersonate another person.

5. The Observatory, voice conversation, and AI summaries

NovaUp is a gratitude journal and personal reflection tool. It is not a medical service and is not a replacement for medication, therapy, counseling, psychiatric care, or other professional medical or mental-health support. Do not start, stop, or change medication based on anything in NovaUp.

AI features can be inaccurate or unexpected and are offered for reflection and encouragement only. They are not professional, medical, legal, financial, or mental-health advice. The Observatory is not an emergency service.

6. Account termination

You may delete your account from within the app. NovaUp may suspend access for material violations, safety risks, legal exposure, or discontinuation of the Service.

7. Service availability and changes

The Service is provided on an "as is" and "as available" basis. Features may change or be discontinued, and material term changes will include an updated date.

8. Disclaimers and limitation of liability

To the fullest extent permitted by law, Pixel Geek LLC disclaims warranties and limits total liability for claims relating to the Service to the greater of amounts paid in the prior twelve months or $50.
